We, Us, Our and similar expressions, refer to Pago International Pty Limited (ABN 40 613 903 816) (Pago) and where applicable its Related Bodies Corporate.

1. What is this document?

1.1. Pago is committed to protecting your personal information in accordance with the Australian Privacy Principles (APPs) in the Privacy Act 1998 as amended. Personal Information includes information about an individual who is reasonably identifiable.

1.2. This document is our Privacy Policy. If you do not agree to our Privacy Policy, please do not use the website or otherwise provide us with Personal Information.

1.3. By providing your personal information and other information to us through our website or otherwise, you consent to the collection, use and disclosure by us of any information you provide in accordance with our Privacy Policy.

1.4. We may amend this Privacy Policy from time to time. The current version of our Privacy Policy is available on our website at www.Pago .com.au or you can requested copy by contacting us. Please check back periodically for changes, updates and additions.

2. What types of personal information do we collect?

2.1. The types of personal information that we collect about you depends on the dealings you have with us and may include your name, age, date of birth, contact details such as phone, fax, email and mobile, physical address and delivery address, payment methods including bank account and credit card details, product interests, company details along with transactional information such as the type and quantity of products that you purchase or own, records of your communications and interactions with us and behaviour relating to transactions, products, services and activity with our digital services.

2.2. We may not be able to provide our services without your personal information.

3. How personal information is collected and held

3.1. We may collect your personal information and of other persons using our products or services from your interactions and transactions with us, our group companies and other entities that are involved in providing our products or services.

3.2. We collect personal information in a number of ways, including:

3.2.1. When you make an in-store purchase;

3.2.2. When you make an online purchase;

3.2.3. When you request information about our products or services;

3.2.4. When you visit certain parts of our website where you are invited to provide content, submissions and suggestions, visitorship data or participate in interactive online activities (i.e. community postings, voting, chat, or bulletin boards);

3.2.5. When you interact with our digital services or provide information via social media pages or download any Apps such as providing your name or contact details via the our Facebook pages, or our Twitter or Instagram accounts or other social media sites or Apps;

3.2.6. From our partners, suppliers, associates or other companies in the Pago group;

3.2.7. We may monitor and record your communications with us (including email and telephone) for quality and training, security and dispute resolution purposes;

3.2.8. From third parties including public sources, information service providers, credit reporting agencies or anyone authorized to act on your behalf.

3.3. We may also collect information by other means and will take all reasonable steps to inform you if and when we do.

4. Why we collect Personal Information

4.1. We collect, hold, use and disclose your personal information so that we may:

4.1.1. provide you with the products or services you purchase;

4.1.2. provide you with information about the products or services;

4.1.3. tell you about products and services and provide information to our third party marketing partners, subject to this Privacy Policy;

4.1.4. respond to your requests for information;

4.1.5. process survey results and other data you provide;

4.1.6. process contest entries;

4.1.7. process online purchases and payments;

4.1.8. send you products you order;

4.1.9. filter the products and information we offer; and

4.1.10. open, maintain and administer user accounts.

4.3. If permitted by law, we may disclose information collected about you as an asset of the company in conjunction with the purchase and potential purchase of our company or a portion of our assets. Any personal information that is disclosed to such a third party will remain subject to the protections in the APPs.

5. Sharing of Personal Information and cross-border disclosure

5.1. We may share your personal information with third parties where appropriate for the purposes set out in the Privacy Policy, including:

5.1.1. Other companies in the Pago group;

5.1.2. Institutions for payment processing;

5.1.3. Service providers engaged to assist with services including sales, distribution, logistics and delivery, data processing, data analysis, information broking, credit reporting, online computing, printing, contact centre, legal, accounting, business consulting, marketing, research, auditing, archival, delivery, security, investigation, and mailing services.

5.2. The third parties to whom we disclose personal information may be located in Australia and other countries including [insert other countries if applicable]. We take steps to ensure that all our service providers agree to protect the privacy and security of your personal information, and use it only for the purpose for which it is disclosed.

6. Direct marketing and opting out

6.1. From time to time, we and our affiliates may communicate with you regarding your transactions and the administration of your account, current projects, special offers, invitations to events, offers for services, new product previews, updates to our products, press releases and announcements concerning the products we provide, contests and sweepstakes, as well as important changes in our General Terms and Conditions and this Privacy Policy.

6.2. By providing us with your address, email address and/or your mobile phone number, you consent to receiving such communications. We may send you this information in a number of ways, including by mail, email, social media, SMS, MMS, telephone and any of our Apps that you download.

6.3. If at any time you decide for any reason that you no longer wish to receive such communications, you can opt out of receiving them by using one of the following methods:

6.3.3. Selecting the "opt out" or "unsubscribe" link, or follow the opt out instructions that may be included in such communication;

6.3.5. Advising us if you receive a marketing call that you no longer wish to receive these calls.

6.4. Please be aware that when you opt out of receiving communications, it may affect the services you have chosen to receive from us where accepting the communications is a condition of receiving such services.

7. Access to, and correction of, personal information

7.1. If at any time you want to know what personal information we hold about you, correct such information or have any questions or complaints you are welcome to contact us by:

7.2. We aim to respond to most requests for access within [30] days subject to some exceptions permitted by law. We may however charge a fee to cover our reasonable costs of locating the information and providing it to you.

7.3. If you ask us to correct personal information that we hold about you, or if we are satisfied that the personal information we hold is inaccurate, out of date, incomplete, irrelevant or misleading, we will take reasonable steps to correct that information to ensure that, having regard to the purpose for which it is held, the information is accurate, up-to-date, complete, relevant and not misleading. If so, we will take reasonable steps to do so, unless this would be impracticable or unlawful. 7.4. In most cases, we expect that complaints will be investigated and a response provided within 30 days of receipt of the complaint. If the matter is more complex and our investigation may take longer, we will contact you and tell you when we expect to provide our response.

8. Digital Services and site visitorship data

8.1. We provide information and services through a range of digital and online services including websites, email and social media profiles. Some information we collect, for example is not related to an individual. In many cases, the information relates only to a device or is of an aggregated or statistical nature, and we will have no way of knowing the identity of the user. In other cases, we may associate information about your use of our digital services over time with your personal information, for example, when on any occasion you have logged in, followed a link sent to you by email, or we have otherwise been able to identify you.

8.2. Site visitorship data is information about the way a website is used that is not associated with an individual’s identity. We use anonymous data regarding online behavior to better understand how people use our products and services. To that end, we may use aggregated, anonymous online traffic behavior, along with information from third parties to track usage trends and thereby improve the services. 8.3. Most site visitorship data is collected using data collection tools such as web beacons, cookies, embedded web links and other software (together “Data Collection Tools”). Data Collection Tools are typically small data files or software that are sent to your browser and stored on your computer's or mobile device's hard drive. Most browsers and display software can be set to inform you when Data Collection Tools are being used or other tracking software is being sent to your computer or Personal Communication Device. They also provide you with the option of refusing such Data Collection Tools. However, refusing to allow the use of Data Collection Tools may, in some cases, preclude you from using, or negatively impact the display or function of, certain areas or features of the services, including preventing you from purchasing products.

8.4. Data Collection Tools may store the information in your shopping cart and allow us to relate your use of the services to other information about you, including your Personal Information. We may do this to improve and personalise your experience and help resolve problems you experience through your use of the website.

9. Security

9.1. We hold personal information electronically and in hard copy form, both at our own premises and with the assistance of our service providers. We implement a range of measures to protect the security of that personal information. The steps we take to secure personal information include website protection measures, security restrictions on access to our premises and computer systems.

9.2. We also take measures in respect of destroying or de-identifying personal information that is no longer needed for any lawful purpose.

While we endeavour to protect the personal information of users of our websites, we cannot guarantee the security of information you disclose online: you disclose that information at your own risk.

10. Hyperlinks and Referrals

10.1. Other websites accessible through the services (through hyperlinks, advertisements or otherwise) have their own privacy policies and data collection, use and disclosure practices. Please consult their terms and conditions and privacy policies prior to use. We do not, even periodically, review the privacy policies or terms of use of third parties and we are not responsible or liable for their privacy practices, availability or reliability of the services they may provide, or the accuracy or completeness of their content.

11. Mobile Terms of Service

11.1 Our mobile message service (the "Service") is operated by Pago International. Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes. By consenting to receive marketing materials from Pago International , you agree to receive SMS/text messages from and on behalf of Pago International through your mobile provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders). You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase. Your participation in this program is completely voluntary. We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your mobile provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your mobile provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your mobile provider. You may opt-out of the Service at any time. Text the single keyword command STOP or click the unsubscribe link (where available) in any text message to cancel. You will receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Pago International mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.
